The Power To Enable


Let me start with a little bit of history on this historic and I feel, one of the most important weekends ever for our great nation.

On this day in history, March 20th 1923, the Bavarian Minister of Interior refuses to forbid Nazi SA, The Sturmabteilung abbreviated to SA (German for “Storm detachment” or “Assault detachment). They were better known to Americans and usually translated as “stormtroopers”. The SA functioned as a paramilitary organization of the Nazi Party. It played a key role in Adolf Hitler’s rise to power in the 1920s and 1930s.

On this day in history, March 20th 1933, the Dachau concentration camp was built by the coalition government of National Socialist Party (Nazi Party) and the German Nationalist People’s Party (dissolved on 6 July 1933). Heinrich Himmler officially described the camp as the first concentration camp for political prisoners. Dachau was operated until 1945. It became the prototype for all other camps. 25,613 prisoners died in the main camp and almost another 10,000 in its outlying camps.

And, finally, but not quite on this day, on March 23, 1933, The Enabling Act (German: Ermächtigungsgesetz) was passed by Germany’s Reichstag and signed by President Paul von Hindenburg. It was the second major step, after the Reichstag Fire Decree, (you will recall one of my earlier daily Rants that included this) through which Chancellor Adolf Hitler legally obtained plenary powers and established his dictatorship. It received its name from its legal status as an enabling act granting the Cabinet the authority to enact laws without the participation of the Reichstag for four years.

The formal name of the Enabling Act was Gesetz zur Behebung der Not von Volk und Reich (Law to Remedy the Distress of the People and the Nation). Hope and Change my Patriot friends.

In United States constitutional law, plenary power is a power that has been granted to a body in absolute terms with no review of it decisions or with limitations on the exercise of those powers. The assignment of a plenary power to one body divests all other bodies from the right to exercise that power.

A clear example of this is with the power of the United States Congress:
The United States Constitution -Article I – The Legislative Branch, Section 8 – Powers of Congress, Clause 3, (the Commerce Clause) To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;
Because Congress is granted absolute power over interstate commerce, the Supreme Court has found that states may not pass laws that affect interstate commerce unless the U.S. Congress gives them permission to do so.

An example of a plenary power granted to an individual is the power to grant pardons, which is bestowed upon the President of the United States:
The United States Constitution -Article II – The Executive Branch, Section 2 – Civilian Power over Military, Cabinet, Pardon Power, Appointments; The President is granted the power to: “…grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.”

Now, please don’t take me wrong here, as I am not equating the current administration with Nazi Germany under Hitler and its crimes against humanity. BUT, I am saying that they are moving dangerously close to fascism in their tactics and power grabs.

Large power grabs that are not fought against, usurpations of power that are given appeasement by the people, always end up bad. Do we really want people like Barney Frank in charge of our lives? Chris Dodd, Chuck Schumer, or even Charles Bernard “Charlie” Rangel? And for my Democratic friends, would you want G.W. Bush, Carl Rove or Dick Chaney granting you permission to get a necessary, life saving medical procedure? Hummmm?

This power grab that is being attempted by this current regime is nothing short of an Enabling Act. It is granting power to our government to control our lives. And for what, so we get free health care? Free my ass. Nothing is free. It just lets you and I pay an additional trillion dollars directly to Washington for the privilege of staying out of jail. Taxes, fines, interest, jail time do not sound like freedoms to me, do they to you?

In the health care takeover, they need to hire 16,000 more agents at our favorite government agency the IRS to enforce your compliance with the new taxes, penalties, fines, and payments for your free health care. Earlier this year, that agency purchased a whole new round of shot guns. Hummm?

Where do we go from here? How much of our constitutional freedoms will be lost this weekend if this bill is passed. How much more will be lost in the coming months and years. Pelosi has already said they will be adding taxes and rules to this after it passes.

Cass Sunstein, the controversial Harvard University law professor who has been hired by President Obama to head the White House Office of Information and Regulatory Affairs said in his book “Democracy and the Problem of Free Speech”, there is a need to “reformulate First Amendment law” and that it is animal cruelty to eat meat and that animals should be given person hood in order that they would be able to hire a lawyer by proxy to sue people.
On taxes he is even better. “We should celebrate tax day.” He argues that since government protects and preserves property and liberty, individuals should happily finance it with their tax dollars:

“In what sense is the money in our pockets and bank accounts fully ‘ours’?… Without taxes, there would be no liberty… There is no liberty without dependency.” He goes on to say, “If government could not intervene effectively, none of the individual rights to which Americans have become accustomed could be reliably protected…This is why the overused distinction between “negative” and “positive” rights makes little sense. Rights to private property, freedom of speech, immunity from police abuse, contractual liberty and free exercise of religion—just as much as rights to Social Security, Medicare and food stamps—are taxpayer-funded and government-managed social services designed to improve collective and individual well-being.

On marriage, he says, “proposes that government recognition of marriage be discontinued. Under our proposal, the word marriage would no longer appear in any laws, and marriage licenses would no longer be offered or recognized by any level of government,”

People like this are about to be in control of all aspects of your and my lives. Sounds great doesn’t it. Will we all just let them takeover our lives because we hated George W. Bush. Because we want free health care, because we want free college. Because insurance companies make enough profit in one year to pay for one day of nationalized health care. Because the white middle class of this country has had a good life for too long at the expense of minorities and third world countries it is time to take some of theirs and give it to others. Because some of our dear friends have lived to the age of 60 or older and are now retired and not contributing to the collective and need to spend a lot of money on health care that we deny them anything except a pain pill and the right to die.

This is not a rant against our government or against paying taxes or even against the IRS. It is a warning against allowing ourselves to continue on this path toward more and more control of our lives. We have the best form of government in the world, we need to pay taxes to pay for the things our country needs and the Internal Revenue Service is made up of mostly good people just going about their daily lives like the rest of us.

Where does it all stop? Maybe the world will look back in history and see that the beginning of the end started on March 20, 2010. The “Last Great Hope For Freedom In The World” started its march toward national suicide. They will see that we gave up our freedoms on Sunday, March 21, 2010 to corrupt politicians who were getting and giving bribes and kick backs to each other. And they will see that on Monday, March 22, 2010 thousands and thousands of gun wielding Sturmabteilung agents were hired to enforce the payments, fines, taxes, compliance, penalties and jail time for this FREE health care.
